Introduction

1.1 These terms and conditions apply between you, the user of this website and/or purchaser of services, and Dr Appraisals, operated by Boyson Healthcare Ltd, trading as Dr Appraisals.

1.2 These terms apply to your use of the website www.drappraisals.com and to any services purchased through or arranged by Dr Appraisals, unless separate written terms are agreed.

1.3 By using the website, purchasing a service, booking an appraisal, submitting documents, or proceeding with an appraisal, you agree to be bound by these terms and conditions.

1.4 If you do not agree to these terms, you should not use the website or purchase any services.

1.5 Nothing in these terms affects your statutory rights.

 

Definitions

2.1 In these terms:

“Dr Appraisals”, “we”, “us” or “our” means Dr Appraisals, operated by Boyson Healthcare Ltd.

“User”, “you” or “your” means any person using the website or purchasing services.

“Website” means www.drappraisals.com and any related pages or subdomains.

“Appraisee” means the doctor receiving an appraisal.

“Appraiser” means the doctor or professional engaged by Dr Appraisals to undertake or support the appraisal.

“Service” means any appraisal, feedback, advice, observership, document review, or other service purchased or arranged through Dr Appraisals.

“Appraisal Summary” means the written output, summary, statement, REV12 form, or other appraisal-related documentation produced following an appraisal.

“Responsible Officer” or “RO” means the doctor responsible for making revalidation recommendations for a doctor, where applicable.

“Designated Body” means the organisation with which a doctor has a prescribed connection for revalidation purposes, where applicable.

 

Use of the Website

3.1 You must use the website lawfully and responsibly.

3.2 You must not use the website in any way that causes, or may cause, damage to the website; interferes with another person’s use of the website; is unlawful, fraudulent, harmful, abusive, threatening, defamatory or otherwise objectionable; uploads, transmits or distributes viruses, malware, spam, or other harmful material; or copies, reproduces or stores protected content without permission.

3.3 We may suspend, restrict or terminate access to the website if we reasonably believe that these terms have been breached.

 

Intellectual Property

4.1 All content on the website, unless uploaded by users, is owned by or licensed to Dr Appraisals.

4.2 This includes text, graphics, images, videos, documents, forms, templates, page layout, design, software, logos and other materials.

4.3 You may access, view, download and print content for your own personal, non-commercial use only.

4.4 You must not copy, reproduce, modify, distribute, sell, publish or use our content for commercial purposes without our written permission.

4.5 Any appraisal forms, pre-appraisal documents, guidance documents, templates or internal documents provided by Dr Appraisals remain the intellectual property of Dr Appraisals. They must not be copied, adapted, reused, sold, shared, or used outside their intended purpose without written permission.

 

Information Provided by Users

5.1 You are responsible for ensuring that any information you provide to us is accurate, complete and not misleading.

5.2 You must inform us promptly if any information you have provided changes.

5.3 You must not upload or submit content that is confidential, false, fraudulent, defamatory, obscene, threatening, abusive, unlawful, or that infringes any third-party rights.

5.4 You must ensure that any patient, colleague or third-party information you provide is appropriately anonymised unless there is a lawful and appropriate reason to include identifiable information.

5.5 You agree to indemnify Dr Appraisals for any claims, losses, liabilities or expenses arising from information or content you provide that is inaccurate, unlawful, inappropriate, misleading, or infringes third-party rights.

 

Appraisal Services

6.1 Dr Appraisals provides independent medical appraisal services. We are not a designated body and we do not act as your Responsible Officer.

6.2 By proceeding with an appraisal, you confirm that you are eligible for, and there is a requirement for you to have, a medical appraisal; that you either do not currently have a prescribed connection or designated body, or you have the agreement of your Responsible Officer or designated body to proceed with an independent appraisal; that you have not had the same appraiser at Dr Appraisals for more than three consecutive years, unless this has been expressly discussed and agreed; and that the information you provide for your appraisal is accurate, complete and your own work.

6.3 You are responsible for ensuring that an appraisal undertaken through Dr Appraisals is appropriate for your individual revalidation circumstances.

6.4 We do not guarantee any particular revalidation outcome, Responsible Officer recommendation, GMC decision, employment outcome, or acceptance of the appraisal by any third party.

6.5 An appraisal is a professional discussion and reflective process. It is not a guarantee that your supporting information will be accepted as complete or sufficient by the GMC, a Responsible Officer, a designated body, employer, regulator, or any other organisation.

 

Pre-Appraisal Requirements

7.1 You must complete the required pre-appraisal documentation fully and honestly.

7.2 Unless you have purchased a Same-Day service or we have agreed otherwise, you must return the completed pre-appraisal document at least 24 hours before the scheduled appraisal meeting.

7.3 You must not leave sections blank. If you have no activity or evidence for a section, you should state this clearly and provide a brief reason.

7.4 You must provide supporting information in the format requested by Dr Appraisals.

7.5 You must not include patient or colleague identifiers unless this is necessary, appropriate and lawful. Patient-identifiable information should be removed wherever possible.

7.6 You must not use artificial intelligence or external assistance to complete reflective sections or declarations where these are required to be your own work.

7.7 We reserve the right to postpone, reschedule, decline to proceed with, or require further information before an appraisal if the pre-appraisal documentation is incomplete, late, unclear, inaccurate, misleading, or unsuitable.

 

Remote Appraisal Meetings

8.1 Appraisals are usually conducted remotely by video call.

8.2 You are responsible for ensuring that you have a reliable internet connection and appropriate access to the video meeting platform.

8.3 You must attend the meeting on time.

8.4 Remote appraisals should ordinarily be conducted with cameras on. You may be asked to show photographic identification.

8.5 If you fail to attend, attend late, cannot access the meeting due to your own technical issue, or are unable to participate appropriately, this may be treated as non-attendance.

 

Fees and Payment

9.1 Fees for services are as stated on the website, invoice, booking page, payment link or other written communication at the time of purchase.

9.2 Payment must be made in full unless we have agreed a different payment arrangement in writing.

9.3 Where a balance remains unpaid, Dr Appraisals may suspend, delay or withhold the service until payment is received.

9.4 Dr Appraisals reserves the right to withhold the Appraisal Summary, REV12 form, appraisal output, written advice, certificate, or any other service output until all outstanding payments have been received in cleared funds.

9.5 You remain liable for any outstanding fees where a service has been booked, arranged, commenced, undertaken, or completed.

9.6 We may correct pricing errors. If a service has been purchased at an incorrect price due to an obvious error, we may contact you to request the correct payment or cancel and refund the order.

 

Complex Appraisal Add-On

10.1 Some appraisals require a complex appraisal add-on. You must purchase the complex appraisal add-on alongside your appraisal package if you are subject to a GMC investigation or MPTS hearing, or have had any licence conditions imposed, including suspension; if you are subject to investigations, hearings, licence restrictions, licence conditions, suspension, or other licence to practise issues with any medical regulator or licensure outside the UK; if you are subject to employment investigations, suspensions, disciplinary processes, capability processes, or malpractice processes; or if you have been involved in criminal activity, received a conviction, caution, warning, fixed penalty notice, or been subject to any criminal process that could, or has, an impact on your fitness to practise.

10.2 It is your responsibility to select the correct appraisal service and any required add-ons based on your circumstances.

10.3 If you should have purchased the complex appraisal add-on but did not do so, whether intentionally or accidentally, Dr Appraisals will require payment of the outstanding fee before the appraisal proceeds.

10.4 If it becomes apparent during the appraisal meeting that your circumstances meet the criteria for a complex appraisal, and the complex appraisal add-on has not been purchased, Dr Appraisals will require payment of the outstanding fee before releasing the Appraisal Summary, REV12 form, or any other appraisal output.

10.5 Dr Appraisals may pause work on the appraisal output until the relevant additional fee has been paid.

10.6 Failure to purchase the correct service or add-on may delay the appraisal process, the production of the appraisal output, and any associated documentation.

 

Turnaround Times and Delays

11.1 Any turnaround times stated on the website, booking page, service description, email, invoice, or other communication are indicative and apply only where the appraisal process is straightforward and all required information has been provided on time.

11.2 Any stated turnaround time or deadline will not apply where there is disagreement about the Appraisal Summary, REV12 form, appraisal statement, or other appraisal output; where further clarification, evidence, communication, correction, or confirmation is required from the appraisee; where further communication is required with a Responsible Officer, designated body, employer, regulator, indemnity organisation, or other external body; where the appraiser considers it necessary to seek advice from, or make a referral to, an external body such as the GMC, Responsible Officer, designated body, employer, NHS England, indemnity organisation, or other relevant organisation; where concerns arise regarding patient safety, probity, professionalism, health, conduct, fitness to practise, dishonesty, safeguarding, or the accuracy or validity of information provided; where there is an outstanding payment, including an unpaid complex appraisal add-on fee; where the appraisee has not provided required information, supporting evidence, declarations, or comments in a timely manner; or where circumstances arise that are outside the reasonable control of Dr Appraisals or the appraiser.

11.3 In these circumstances, Dr Appraisals will not be liable for any delay in releasing the Appraisal Summary, REV12 form, appraisal output, written advice, certificate, or any other service output.

11.4 Where a delay occurs for any of the reasons listed above, no refund or partial refund will be due solely because the original turnaround time was not met.

 

Rescheduling, Late Cancellation and Non-Attendance Fees

12.1 A rescheduling fee of £75 will apply if you cancel or request to reschedule your appointment with less than 7 days’ notice, but more than 24 hours’ notice, including Fast-Track appointments.

12.2 A rescheduling fee of 50% of the cost of the appraisal will apply if you fail to attend your meeting appointment within 5 minutes of the scheduled start time; if you cancel your appointment with less than 24 hours’ notice; or if you do not return your completed Pre-Appraisal Document at least 24 hours before the scheduled meeting, unless you have purchased a Same-Day service.

12.3 If you do not attend, attend late, cancel late, or fail to provide the required documentation in time, we may need to rearrange the appraisal. Any rearranged appointment will be subject to the applicable rescheduling fee.

12.4 We may waive or vary a rescheduling fee at our discretion, but we are not obliged to do so.

 

Refunds and Cancellations

13.1 Refund requests are accepted within 14 days of purchase or up until an appraisal meeting has been booked, whichever is sooner.

13.2 Where a refund is accepted under clause 13.1, a full refund will be provided minus 10% of the value of the purchase to cover merchant, administrative and processing costs.

13.3 If an appraisal meeting has been booked and you choose to cancel more than 7 days before the appraisal date, a 50% refund will be available.

13.4 No refund will be available within 7 days of the appraisal date; where you fail to attend the appraisal; where you cancel with less than 24 hours’ notice; where you return the Pre-Appraisal Document late and the appraisal cannot proceed; where the appraisal has already taken place; where the Appraisal Summary or other output has already been produced; where you are dissatisfied because the appraiser’s professional judgment does not match the outcome or wording you expected; where you disagree with the Appraisal Summary, REV12 form, appraisal statement, or other appraisal output; where release of the appraisal output is delayed because further clarification, communication, advice, escalation, or external referral is required; or where release of the appraisal output is delayed because an outstanding payment remains unpaid.

13.5 Refunds are not available simply because an appraisal does not result in the outcome you wanted, including but not limited to revalidation progression, Responsible Officer acceptance, GMC acceptance, employment progression, or acceptance by a designated body.

13.6 Any discretionary refund or credit will be made without admission of liability and will not create an obligation to provide similar refunds in the future.

 

Disagreement with Appraisal Summary or Output

14.1 The Appraisal Summary and any appraisal output are the professional and objective output of the appraisal discussion, supporting information, and the appraiser’s professional judgment.

14.2 The appraiser is required to provide an honest, balanced and objective summary. The appraiser is not required to amend their professional view solely because the appraisee disagrees with it.

14.3 If you disagree with any part of the Appraisal Summary or appraisal output, or if you refuse to sign off an appraisal because you disagree with the appraiser’s objective summary or professional judgment, this does not entitle you to a refund.

14.4 If you disagree with anything written in the Appraisal Summary, you will have the opportunity to record your comments in the appraisee comments section before sign-off, in accordance with standard appraisal practice.

14.5 Factual corrections may be considered where appropriate. However, Dr Appraisals and the appraiser are not required to remove or alter professional opinion, concerns, recommendations, or objective commentary where the appraiser considers these to be appropriate.

 

Reviews, Public Statements and Defamatory Comments

15.1 You are entitled to provide honest feedback or leave a fair review about your experience of the service provided by Dr Appraisals.

15.2 Nothing in these terms prevents you from leaving a genuine, lawful and honest review about matters such as the booking process, communication, administration, meeting arrangements, timeliness, professionalism, or general customer experience.

15.3 However, you must not publish, post, share, repeat, or encourage others to publish any false, misleading, malicious, defamatory, libellous or slanderous statement about Dr Appraisals, Boyson Healthcare Ltd, any appraiser, any member of staff, or any person acting on behalf of Dr Appraisals.

15.4 You acknowledge that an appraisal is a professional process and that the Appraisal Summary, REV12 form, appraisal statement, and any other appraisal output are based on the appraiser’s professional judgment, the appraisal discussion, and the supporting information provided.

15.5 You must not publish or imply that Dr Appraisals or an appraiser has acted improperly, dishonestly, negligently, unfairly, unlawfully, maliciously, fraudulently, discriminatorily, or outside professional standards simply because you disagree with the Appraisal Summary, REV12 form, appraisal statement, or other appraisal output; because you disagree with the appraiser’s professional judgment, comments, concerns, recommendations, or wording; because the appraiser declines to amend or remove professional opinion, concerns, recommendations, or objective commentary; because you choose not to sign off the appraisal because you disagree with the content; because the appraisal output is not accepted by a Responsible Officer, designated body, employer, GMC, regulator, or other third party; because a Responsible Officer, designated body, employer, GMC, regulator, or other third party makes a decision you disagree with following the appraisal; because the appraiser seeks advice, raises a concern, or makes a disclosure in accordance with their professional obligations; or because the release of the appraisal output is delayed because further clarification, communication, advice, escalation, external referral, or payment is required.

15.6 If you are dissatisfied with the service provided by Dr Appraisals, you should raise this through our complaints process so that the matter can be reviewed appropriately.

15.7 You may express that you were dissatisfied with the service or that you disagreed with the appraisal outcome, provided that any public or private statement you make is honest, accurate, fair, proportionate, and not misleading.

15.8 If you publish or share a statement that Dr Appraisals reasonably considers to be false, misleading, malicious or defamatory, we reserve the right to request that you correct, amend or remove it.

15.9 Dr Appraisals reserves all rights to take appropriate action where false, misleading, malicious, defamatory, libellous or slanderous statements cause, or are likely to cause, reputational damage, financial loss, professional harm, or other loss to Dr Appraisals, Boyson Healthcare Ltd, an appraiser, staff member, contractor, or representative.

 

Appraiser Professional Responsibilities, Concerns and Disclosure

16.1 By undertaking an appraisal with Dr Appraisals, you acknowledge that the appraiser has professional duties as a registered doctor and appraiser.

16.2 These duties may include seeking advice, escalating concerns, or disclosing relevant information where the appraiser has concerns about patient safety, public protection, probity, professionalism, health, conduct, fitness to practise, dishonesty, safeguarding, or the accuracy or validity of information provided during the appraisal process.

16.3 Where the appraiser reasonably considers it professionally, legally, ethically, or regulatorily necessary, the appraiser may seek advice from, or raise concerns with, relevant organisations or individuals. These may include, but are not limited to, the General Medical Council, your Responsible Officer, your designated body, your current, former or prospective employer, NHS England or another responsible body, any relevant regulator, statutory body, safeguarding body, indemnity organisation, or professional organisation.

16.4 Where such advice, escalation or disclosure is considered necessary, you agree that the appraiser and/or Dr Appraisals may share your details, relevant appraisal information, supporting information, and details discussed during the appraisal.

16.5 Such disclosure may take place with or without your further consent where the appraiser reasonably considers that disclosure is required, justified, or appropriate in the public interest, for patient safety, for regulatory purposes, or to meet professional obligations.

16.6 Where possible and appropriate, the appraiser may discuss the concern with you before making a disclosure. However, the appraiser is not required to do so if this would increase risk, compromise patient safety, prejudice an investigation, or conflict with professional, legal or regulatory duties.

16.7 Dr Appraisals and its appraisers will aim to disclose only information that is relevant and proportionate to the concern or advice being sought.

 

Supporting Information and Appraisal Evidence

17.1 You are responsible for providing appropriate supporting information for your appraisal.

17.2 Supporting information should be relevant to your scope of work and appraisal year.

17.3 Where required, you should provide evidence of CPD, quality improvement activity, significant events, complaints, compliments, patient feedback, colleague feedback, health declarations and probity declarations.

17.4 Dr Appraisals may provide guidance on supporting information, but you remain responsible for ensuring that your evidence is suitable for your appraisal and revalidation circumstances.

17.5 Dr Appraisals does not guarantee that evidence from overseas practice, observerships, non-medical roles, clinical attachments, or other activities will be accepted by the GMC, a Responsible Officer, designated body, employer, regulator, or any other organisation.

 

Use of AI Meeting Notes, Transcripts and Storage

18.1 Your appraiser may use AI-assisted meeting notes to support the preparation of the Appraisal Summary, REV12 form, appraisal output, or other appraisal-related documentation.

18.2 Where AI-assisted meeting notes are used, the appraisal discussion may be transcribed or otherwise recorded in written form so that notes can be generated from the discussion.

18.3 The transcript and AI-generated notes may contain personal data, professional information, appraisal information, and details discussed during the appraisal meeting.

18.4 AI-assisted notes are used as an administrative support tool only. The appraiser remains responsible for reviewing the notes, exercising professional judgment, and producing the final Appraisal Summary or appraisal output.

18.5 Transcripts, AI-generated notes, and related appraisal records will be stored securely and handled in accordance with our Privacy Policy, data protection obligations, and internal information governance arrangements.

18.6 Access to transcripts, AI-generated notes, and related appraisal records will be limited to those who reasonably require access for appraisal administration, appraisal summary preparation, quality assurance, record keeping, regulatory purposes, or other legitimate business or professional purposes.

18.7 Transcripts and AI-generated notes may be retained for as long as reasonably necessary for appraisal administration, quality assurance, audit, complaint handling, legal, regulatory, insurance, or professional purposes.

18.8 You should inform your appraiser before the appraisal meeting if you do not agree to AI-assisted note-taking or transcription being used. Where you object, Dr Appraisals will consider whether the appraisal can proceed without AI-assisted note-taking or whether alternative arrangements are required.

 

Third-Party Links and External Services

19.1 The website may include links to third-party websites or services.

19.2 Unless expressly stated, these third-party websites and services are not controlled by Dr Appraisals.

19.3 We are not responsible for the content, availability, accuracy, performance, policies or practices of third-party websites or services.

19.4 The inclusion of a link does not imply endorsement.

 

Privacy and Cookies

20.1 Use of the website and services is also governed by our Privacy Policy and Cookies Policy.

20.2 These policies are incorporated into these terms by reference.

20.3 You should review these policies before using the website or purchasing services.

 

Website Availability and Disclaimers

21.1 The website and any online facilities, tools, services or information are provided on an “as is” and “as available” basis.

21.2 We do not guarantee that the website or services will be uninterrupted, error-free, secure, or free from viruses or other harmful material.

21.3 We may alter, suspend or discontinue any part of the website, including products or services, at any time.

21.4 We are under no obligation to update information on the website, although we may do so from time to time.

 

Limitation of Liability

22.2 To the maximum extent permitted by law, Dr Appraisals will not be liable for business losses; loss of profits, income, revenue, anticipated savings, contracts, goodwill or commercial opportunities; loss or corruption of data, databases or software; indirect or consequential loss; losses arising from events outside our reasonable control; or decisions made by the GMC, Responsible Officers, designated bodies, employers, regulators or third parties following an appraisal.

22.3 Dr Appraisals does not guarantee any particular appraisal, employment, regulatory, revalidation or professional outcome.

 

Changes to These Terms

23.1 We may update these terms from time to time.

23.2 Updated terms will apply from the date they are published on the website, unless otherwise stated.

23.3 You should check the terms regularly to ensure that you understand the current version.

 

General Terms

24.1 You may not transfer your rights or obligations under these terms to another person without our written agreement.

24.2 We may transfer our rights or obligations where we reasonably believe your rights will not be adversely affected.

24.3 These terms, together with our Privacy Policy and Cookies Policy, contain the whole agreement between the parties relating to their subject matter.

24.4 No third party has any right to enforce any provision of these terms under the Contracts (Rights of Third Parties) Act 1999.

24.5 If any part of these terms is found to be invalid, unlawful or unenforceable, that part will be treated as deleted to the extent necessary. The rest of the terms will remain valid and enforceable.

24.6 No delay, act or omission by either party in exercising any right or remedy will amount to a waiver of that or any other right or remedy.

 

Governing Law and Jurisdiction

25.1 These terms are governed by the law of England and Wales.

25.2 Any disputes arising under or in connection with these terms, including non-contractual disputes or claims, will be subject to the exclusive jurisdiction of the courts of England and Wales.
